Terms and Conditions for Black Diamond Rides, LLC

1. Introduction
Welcome to Black Diamond Rides, LLC ("we," "our," "us"). By using our luxury black car SUV services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our services. If you do not agree with any part of these terms, please do not use our services.
2. Services
2.1 Service Description: We provide luxury black car SUV services for transportation in Austin, Texas. Our services include, but are not limited to, point-to-point transportation, hourly bookings, airport transfers, and corporate travel.
2.2 Service Availability: Our services are available 24/7, subject to vehicle and driver availability. We reserve the right to refuse service to anyone at our discretion.
3. Booking and Payment
3.1 Booking: You can book our services through our website, mobile application, or customer service hotline. All bookings are subject to confirmation and availability.
3.2 Payment: Payment for services can be made using credit/debit cards or other accepted payment methods at the time of booking. All payments are due in full at the time of booking unless otherwise agreed upon.
3.3 Pricing: Our pricing is subject to change without notice. The price at the time of booking will apply. Additional charges may apply for extra services or waiting time.
4. Cancellations and Refunds
4.1 Cancellations: You may cancel your booking up to 24 hours before the scheduled pick-up time without any penalty. Cancellations made less than 24 hours before the scheduled pick-up time will incur a cancellation fee of 50% of the total booking cost. Cancellations made within six (6) hours of the scheduled pick-up time will be charged the full amount.
4.2 Refunds: Refunds will be processed within 7-10 business days after the cancellation request is received and approved. Refunds will be issued to the original payment method used at the time of booking.
5. Passenger Conduct
5.1 Behavior: Passengers are expected to conduct themselves in a respectful and orderly manner. Any behavior that is deemed inappropriate, abusive, or dangerous may result in the termination of the service without refund.
5.2 Damage: Passengers will be held responsible for any damage caused to the vehicle during the service. The cost of repairs or cleaning will be charged to the passenger.
5.3 Alcohol and Smoking: Consumption of alcohol and smoking are strictly prohibited in our vehicles. Violation of this policy may result in immediate termination of the service without refund.
6. Limitation of Liability
6.1 Service Disruptions: We strive to provide timely and reliable services. However, we are not liable for any delays or disruptions caused by factors beyond our control, including but not limited to traffic conditions, weather, mechanical failures, or acts of God.
6.2 Personal Belongings: We are not responsible for any loss or damage to personal belongings left in our vehicles. Passengers are advised to keep their belongings with them at all times.
6.3 Indemnification: You agree to indemnify and hold harmless Black Diamond Rides, LLC, its employees, and affiliates from any claims, damages, losses, or expenses arising out of your use of our services.

8. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications indicates your acceptance of the new terms.

These terms and conditions are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these terms or your use of our services will be resolved in the courts of Travis County, Texas.

These terms and conditions constitute the entire agreement between you and Black Diamond Rides, LLC with respect to your use of our services and supersede all prior or contemporaneous understandings, agreements, and communications.
11. Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Waiver
Our failure to enforce any right or provision of these terms and conditions will not be considered a waiver of those rights.
